As you know, this inquiry is regarding a September 20, 2007 open records request. There are limits to the amount of delay permitted. We are very concerned that the decision on voting equipment certification might be made by the Department of State before the public has had an opportunity to analyze the records we have requested, or to determine that some or all of these records do not exist. The Secretary has already informed us of his intention to make the equipment certification decision in a secret meeting. It is only by accessing the records we have requested in a timely manner, and educating the public before this secret meeting, can the voters of Colorado have any say in the quality of voting equipment used for elections in Colorado. I believe that you are doing your best to get answers in a timely manner. However, if a decision is made before we have had time to analyze the records, questions will be raised that can result in a significant loss of voter confidence.
Regarding the 50-state lawsuit, I am familiar with this suit. I do have access to these documents, thank you.
My informant reports that Mr. Coffman may have mentioned, in a Sunday TV broadcast on Denver’s channel 9, that a lawsuit was (or might soon be) filed by one or more voting equipment vendors. Is this the case?
