Hi Karen,

I will be away from my office from about 10 AM until as late as 2 PM tomorrow.

There are many things that I hope will be considered for the recount.

1. You might ask who is to perform the recount, and precisely how it is to be accomplished. Will there be a Logic & Accuracy Test?

2. What are the rules for who can observe the recount? And will the observers actually be able to see what is going on, or will they be only able to see that something is going on?

3. I suggest you get a copy of the computer file containing the names of everybody that was mailed a ballot.

4. Inspect the address verification log for the mass mailing. I assume that they used a bulk mail permit and went thru a mailing house – or equivalent – for the bulk mailing. Were any persons mailed ballots that were not eligible to vote?

5. I still have this open question as to whether or not non-resident property owners who are eligible to vote in Boulder county were entitled to vote, and whether they were mailed a ballot.

6. Inspect and count the ballots that were returned undeliverable. Were any undelivered ballots re-mailed, and if so inspect and count them.

7. Inspect, classify and count the returned ballots that were not accepted for counting. How many of these were cured by the voter and actually counted?

8. Select a few batches, and count the ballot stubs corresponding to these batches to verify that the counts match.

9. Get a copy of all ballot tracking logs including batch control logs.

10. Get a copy of the computer file containing the names of all of the voters who cast a ballot.

11. Get a copy of all scanner reports.

12. Get a copy of the procedures used to conduct the original election, including counting and canvassing.

13. Inspect and count all duplicated ballots.

14. Inspect and count all spoiled ballots.

15. Determine the number of YES, NO, over, and under votes. This number should match exactly the number of persons who cast ballots.

16. The clerk will argue that it is only her intention to rescan and count the votes. This is not adequate. Votes can be lost or accidentally changed along the way. Press hard to see if you can get the entire process examined as above.

17. It troubles me that there is no knowledge of what went wrong with the equipment. We must assume that there is a flaw in the equipment that will be used on Thursday. It would be much better if you can persuade the clerk to do hand counts.

As you are aware, the Diebold AccuVote scanning equipment failed to print the election tape for the February 27, 2007 Mail Ballot Election. I met with the Diebold Election Support Consultant today and have determined that a recount of the ballots is warranted. I contacted City Attorney Bill Hayashi, the Secretary of State, and the Colorado Municipal League legal staff for guidance. I am authorized by the Municipal Election Code to make this determination, with no other action required by Council.

The machine (and memory card) that malfunctioned have been shipped to a Diebold diagnostic center. Diebold technicians cannot explain what happened and contend that they have never experienced this outcome before. Theyve agreed that their company will bear the cost of the recount. I will begin at 8:00 a.m. on Thursday, March 8 and deliver certified results of the recount to the Council at the March 20, 2007 Council meeting.
Attached is the Notice of Recount that will be posted in three public places, according to the Municipal Election Code, as well as on the City website. I will inform the Issue Committee Agents of the recount.
